1. Acceptance of Terms
By downloading, installing, accessing, or using IPTV Now ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
IPTV Now is an IPTV client application that allows users to organize and access their own IPTV streams. WE DO NOT PROVIDE, HOST, OR DISTRIBUTE ANY CONTENT. The App is merely a tool for organizing and accessing content that users independently obtain from third-party IPTV providers.
3. User Responsibilities and Content Disclaimer
YOU ARE SOLELY RESPONSIBLE FOR:
- All content you access through the App
- Ensuring you have legal rights to access any content
- Compliance with all applicable laws and regulations
- Any consequences arising from your use of third-party IPTV services
- Verifying the legality of content in your jurisdiction
FC Apps LLC DISCLAIMS ALL RESPONSIBILITY FOR USER CONTENT AND ACTIVITIES.
4. Prohibited Uses
You agree NOT to use the App to:
- Access copyrighted content without proper authorization
- Violate any local, state, national, or international law
- Distribute, share, or redistribute content to third parties
- Reverse engineer, modify, or create derivative works of the App
- Use the App for any commercial purpose without our written consent
- Attempt to circumvent any security measures
5. Subscriptions and Pricing
PRICING CHANGES: We reserve the right to change subscription prices, features, or terms AT ANY TIME without prior notice. Price changes will apply to new subscriptions and renewals. No refunds will be provided for price changes.
- Subscriptions auto-renew unless cancelled
- Cancellation takes effect at the end of the current billing period
- Refunds are subject to Apple App Store and Google Play Store policies only
- We may modify or discontinue subscription plans at our discretion
6. Intellectual Property
The App and its original content, features, and functionality are owned by FC Apps LLC and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services.
7. Privacy
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- That the App will be uninterrupted, secure, or error-free
- That any content accessed through the App is legal, accurate, or reliable
- That third-party IPTV services will remain available or functional
9. Limitation of Liability
MAXIMUM LIABILITY LIMITATION:
IN NO EVENT SHALL FC Apps LLC, ITS FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from third-party content or services
- Legal consequences from your use of the App
OUR TOTAL LIABILITY IS LIMITED TO THE MAXIMUM OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIVE DOLLARS ($5.00).
10. Indemnification
You agree to indemnify, defend, and hold harmless FC Apps LLC and its affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you access through the App
- Any legal action related to your IPTV content or providers
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the App immediately ceases
- We are not obligated to provide refunds
- Sections 3, 6, 8, 9, 10, 12, and 13 survive termination
12. App Store Terms
Additional terms apply based on your platform:
- Apple App Store: Subject to Apple's Licensed Application End User License Agreement
- Google Play Store: Subject to Google Play Terms of Service
- In case of conflict, the more restrictive terms apply
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes must be resolved through binding arbitration in Delaware, except that we may seek injunctive relief in any court of competent jurisdiction.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be replaced with an enforceable provision that most closely reflects our intent.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or other means. Continued use of the App after changes constitutes acceptance of the new Terms.
16. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce such provision in the future.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FC Apps LLC regarding the App and supersede all prior agreements.
